The case filed by Wallace claiming the GPL to be a monopoly was dismissed earlier and that decision has been confirmed by an appellate court. A report on it is available at http://opensource.sys-con.com/read/302979.htm
The decision also holds: "It does not help to characterize people who accept the GPL as 'conspirators'" since the GPL "does not restrain trade. It is a cooperative agreement that facilitates production of new derivative works, and agreements that yield new products that would not arise through unilateral action are lawful."
