Can FSF which is the owner of GPL, file a suit or legal notice to M$ to either come out with facts on its claim of infringement of IP or retract its statement publicly?
The FSF doesn't hold the copyrights to the Linux kernel. There should be no reason to file a case though, because until MSFT actually says which patents are infringed by Linux, the only thing they are doing is spouting FUD. Also, the only country which would be affected by this issue is the US, so you can happily continue to use Linux as is.
Of course, given that Novell's agreement violates the GPL, we are in for some interesting times.
