Can FSF which is the owner of GPL, file a suit or legal notice to M$ to either come out with facts on its claim of infringement of IP or retract its statement publicly?

The FSF doesn't hold the copyrights to the Linux kernel. There should be no reason to file a case though, because until MSFT actually says which patents are infringed by Linux, the only thing they are doing is spouting FUD. Also, the only country which would be affected by this issue is the US, so you can happily continue to use Linux as is.
Of course, given that Novell's agreement violates the GPL, we are in for some interesting times.

Yes, on a personal front there's nothing wrong. But on a wider front, that is adoption of Linux in corporations this can prove an effective FUD. Indian managers and sadly, major number of techies do not care to keep themselves informed and get scared by such FUD. This leads to "Linux is illegal you know, so there's another reason not to use it".
As it is I've had an exhausting time convincing some people that Linux is actually a user friendly desktop ;-)

This is the same technique used many years ago before computers came into existence. During those days there were mechanical cash registers and a big name in the industry would use such methods to beat their rivals. Their salesman would hide outside the rival company salesman's house and would follow his horse carriage. After the rival's guy left the potential customer's office, the salesman would visit that client and tell them that they were having a legal dispute with the rival company and anyone who dealt with them ( rivals ) would get into legal problems too. So the client would simply want to wash his hands off the rival company's product. They even built sub-standard machines with the rival's label and after a breakdown, visit the client to advise him to buy products from his own company only. Later on the same big company got beaten by another that went on to become one of the biggest names in the industry. No names please.

There's another concern. Novell has (it claims) 250 developers working on FOSS projects. What are the chances that some of those developers will put in some tainted code into their project? And what will be the consequences if Microsoft sues based on that code?

Au contraire i used the announcement to bag two good projects. U know how weak M$ is on the tech front - no 64 bit os, no database, no web server, no security- they are obsolete and are cruising at treetop height with no engine power.
